These terms govern your use of the Bargain Bashers marketplace, whether you are buying, selling, or managing listings.

(General Goods & Services Online Auction & Selling Platform — "Bargain Bashers")

Important: These Terms & Conditions ("Terms") are a legally binding agreement between Bargain Bashers ("we," "us," "our"), each seller, and each buyer (together, "users"). By creating an account, listing an item/service, bidding, or purchasing, you agree to these Terms.

1) Definitions

Platform: The Bargain Bashers website, apps, and related services.

Seller / Buyer: Users listing or purchasing goods/services.

Listing: Any item/service offered on the Platform.

Successful Sale: A sale we deem completed under these Terms (e.g., payment captured, delivery confirmed or dispute window closed, as applicable).

Shipment: Hand-over of the item to an Approved Carrier with tracking, or documented in-person delivery.

Approved Carrier: A reputable, legally registered shipping company or national postal service that offers trackable service. Taxis, ride-shares, informal "lifts," or unregistered couriers are not permitted.

2) Account Eligibility & Responsibilities

  • You must be the age of majority in your jurisdiction and able to enter contracts.
  • Keep your account info accurate and credentials secure. You are responsible for activity under your account.
  • We may suspend or terminate accounts for violations, suspected fraud, chargebacks, or unlawful conduct.

3) Platform Role

  • We facilitate listings, bidding, messaging, shipping coordination, and payments. We are not the buyer or seller of listed items and do not take title to goods.
  • We may mediate disputes and coordinate refunds consistent with these Terms.

4) Listings, Bidding & Purchasing

  • Sellers must describe items/services accurately and disclose defects or material limitations.
  • Manipulative practices (e.g., shill bidding) are prohibited.
  • Buyers must review descriptions, photos, and policies before bidding or purchasing.
  • A winning bid or accepted offer forms a binding agreement between buyer and seller, subject to these Terms.

5) Pricing, Fees (15%) & Taxes

  • Our successful-sale fee is 15% of the sale price (the "Platform Fee"), unless we explicitly state otherwise in writing.
  • Additional payment-processing or optional service fees may apply; such fees will be disclosed at checkout or in the seller dashboard.
  • Users are responsible for applicable taxes, customs, and duties. We may collect and remit taxes where required by law.

6) Payments Flow (Bargain Bashers Account) & Holds

  • All buyer payments are made to Bargain Bashers' account.
  • After a transaction is deemed a Successful Sale, Bargain Bashers will pay the seller the net amount, less the 15% Platform Fee (and any disclosed payment/optional service fees).
  • We may place administrative holds on funds to manage risk, address disputes, verify delivery, or comply with law. Release of funds may depend on delivery confirmation, dispute status, and risk assessments.

7) Shipping, Delivery, Approved Carriers, Waybill Number & Risk of Loss

Approved Carriers (Seller duty): Sellers must ship only via reputable, legally registered shipping companies (including national postal services) that provide trackable service. Taxis, ride-shares, informal couriers, or "lift-seeking" are prohibited.

Mandatory Waybill/Tracking Number: Sellers must provide a valid waybill/air waybill/tracking number issued by the Approved Carrier and upload it to the Platform within 24 hours of shipment. The tracking must allow end-to-end status checks until delivery. Failure to provide a valid number may result in payment holds, listing/account actions, cancellation of the transaction, and may affect dispute outcomes.

If this rule isn't respected: Where an unapproved shipping method is used contrary to this clause, the website owner accepts no responsibility for loss or damage, and payment may be processed as a Successful Sale per sections 6 and 8.

Buyer chooses non-reputable shipping: If a buyer insists on a non-reputable/unregistered method, all risk (loss, damage, delay) lies with the buyer, and the seller is not accountable for resulting damages.

Seller forces non-reputable shipping: If a seller forces a non-approved method on a buyer, the seller is in material breach and will be banned from Bargain Bashers.

Packaging & Proof: Sellers must package adequately and upload tracking on the Platform. Buyers must promptly inspect deliveries.

Risk of Loss: Unless section 7(4) applies, risk transfers from seller to buyer upon shipment via an Approved Carrier (or upon documented in-person delivery).

8) Cancellations, Returns & Refunds (Commission Rules)

All cancellations/refunds are handled through the Platform and will be discussed between buyer, seller, and Bargain Bashers before any refund is processed.

A) Cancellation before shipment

If a sale is cancelled before shipment, the buyer is refunded minus a 5% fee (Pre-Shipment Cancellation Fee).

B) Cancellation after shipment (seller agrees)

If cancelled after shipment and the seller agrees:

  • The buyer pays return shipping.
  • After the seller confirms with evidence that the item is in the same condition as sent, the buyer is refunded minus the 15% Platform Fee (treated as a successful sale for fee purposes).

C) Item received damaged; damage not described in listing

If the buyer receives the product damaged and such damage was not described in the listing:

  • The buyer will be refunded minus the 15% Platform Fee, whether the product is returned or not.
  • Return shipping (if required) is paid by the seller.

D) Evidence, Timeframes & Process

  • The party claiming damage/discrepancy must submit clear, date-stamped photos/videos and a description within 72 hours of delivery.
  • We may request additional information (e.g., packaging photos, carrier reports) and may require returns via an Approved Carrier.
  • Refunds are issued to the original payment method.

9) Dispute Resolution Between Users

  • Users must attempt good-faith resolution via the Platform's tools.
  • We may review evidence and issue a determination consistent with sections 7–8.

10) Prohibited Items & Activities

  • Illegal, counterfeit, stolen, dangerous, recalled, or otherwise restricted items are prohibited.
  • We may remove listings that violate law/policy or pose safety/brand risks.

11) Intellectual Property

  • Sellers warrant they own or have rights to the items and content they list.
  • You grant us a non-exclusive, worldwide, royalty-free license to host, display, and promote your listings/content in connection with the Platform.
  • We respond to proper IP notices and may suspend repeat infringers.

12) User Content & Conduct

  • Do not post misleading, defamatory, obscene, or unlawful content.
  • Do not bypass fees, harvest data, or interfere with security.

13) Privacy

Our data practices are described in our Privacy Policy. By using the Platform, you consent to those practices.

14) Warranties & Disclaimers

  • Except as expressly stated, the Platform is provided "as is" and "as available."
  • We do not warrant listing accuracy, seller performance, or buyer payment.
  • To the maximum extent permitted by law, we disclaim all implied warranties (merchantability, fitness, non-infringement).

15) Limitation of Liability

  • To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, data loss, or business interruption.
  • Our total liability relating to the Platform or these Terms is limited to the greater of (a) fees you paid to us in the 6 months before the claim, or (b) N$100.

16) Indemnification

You agree to indemnify and hold harmless Bargain Bashers, our affiliates, and personnel from claims arising out of your listings, purchases, shipping choices, violations of law, or breaches of these Terms.

17) Enforcement, Suspension & Termination

  • We may remove listings, place holds, suspend payments, or terminate accounts to protect users, comply with law, or manage risk.
  • We may set off amounts you owe us against amounts otherwise payable to you.
  • Shipping Violations: Per section 7(5), sellers who force non-approved shipping may be permanently banned.

18) Governing Law; Dispute Resolution with Us

  • These Terms are governed by the laws of the Republic of Namibia.
  • Informal Resolution: Contact support first to try to resolve any issue.
  • Arbitration (if applicable): Except for small-claims matters, disputes between you and us will be resolved by binding, individual arbitration; class actions are waived. If arbitration isn't permitted, disputes will be brought exclusively in the courts of Windhoek, Namibia.

19) Changes to the Platform & Terms

We may modify the Platform or these Terms at any time. Material changes will be posted with an updated date. Continued use after changes means you accept the revised Terms.

Seller/Buyer Acknowledgment

By clicking "I Agree," listing an item, placing a bid, or completing a purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms, including the 15% Platform Fee (sections 5–6), the Approved Carrier & Waybill rules (section 7), and the cancellation/damage provisions (section 8).
